A short addition to this interesting article on the french "loi Doubin".

I fully agree with the recommandation made in the article: it would not be wise to try to circumvent local French law. An additional reason is following: it is very easy to conceive the compulsory document and the risk would really not be worth while.

The Doubin law is not specific to franchising: it applies also to other contractual relationships. As far as it's implementation in a franchise relationship is concerned, the information which must be handed over to the candidate is very insufficient.

Franchising has 4 characteristics: proven success, know how, assistance and a brand. The Doubin law only informs about the brand. Nothing has to be said about the other 3 characteristics.

This is why, we always urge new franchisors to give the candidate additionnal information, specific to franchising.

I read that twice, so long as you don't object I'd like to quote you in an article I'm intending to write. I work with companies in Tenerife and we are up against unique issues. A few of the most important factors being that we are a log way from the mainland and so local expertise, materials and goods all must be brought in from abroad. There are also a whole bunch of bureacratic problems that business owners must surmount. Even so it is a fantastic place to live and it's a small price to pay for some inconvenience. The web is invaluable... I'll be back to read what you have to say at http://www.tenerife-business.com before long!
